CBCA (Civilian Board of Contract Appeals)

CBCA stands for Civilian Board of Contract Appeals. The Civilian Board of Contract Appeals (CBCA) is an independent board that hears disputes between contractors and most civilian federal agencies. It is housed within GSA but decides cases independently.

Under the Contract Disputes Act, a contractor first submits a claim to the contracting officer. If the contracting officer denies it or does not decide in time, the contractor can appeal to the CBCA, generally within 90 days of receiving a final decision.

Why it matters to a small contractor

If a civilian agency refuses to pay for extra work or terminates you unfairly, the CBCA is one place to appeal. The deadlines are strict, so keep records of every change, conversation, and cost as the job goes.

Example

A paving contractor's claim for differing site conditions is denied by a civilian agency's contracting officer, and it files an appeal with the CBCA within 90 days.

CBCA: common questions

What is the difference between the CBCA and GAO?

GAO handles bid protests before or right after award. The CBCA handles disputes that arise during performance of a contract with a civilian agency.

How long do I have to appeal to the CBCA?

Generally 90 days from receiving the contracting officer's final decision. You can instead go to the Court of Federal Claims within 12 months.
