J&A (Justification and Approval)

J&A stands for Justification and Approval. A Justification and Approval, or J&A, is the written explanation an agency must prepare when it buys without full and open competition. It names the legal authority it relies on, such as only one responsible source being able to meet the need, or an unusual and compelling urgency.

The J&A must be approved by the right official, and higher dollar values require higher approval levels. J&As are generally made public after award, so anyone can read the agency's reasoning.

Why it matters to a small contractor

If you see a J&A or a notice of intent to sole source in your trade, you may have a window to tell the agency you can do the work too. Reading posted J&As also shows you which incumbents have locked in work and why, which helps you plan where to compete.

Example

A hospital posts a J&A explaining that it extended a sterilizer maintenance contract with the manufacturer because only the manufacturer had the proprietary diagnostic software. A small biomedical repair firm reads it and starts working toward factory certification.

J&A: common questions

Can I challenge a sole-source decision?

If the agency posts a notice of intent before award, you can respond with evidence that you can meet the need. Formal challenges have strict deadlines, so act quickly and get advice if needed.

Is every sole-source buy covered by a J&A?

Not always. Some programs, such as certain small business sole-source awards and very small purchases, follow their own documentation rules.
