FAR Part 12 (Acquisition of Commercial Products and Commercial Services)

FAR Part 12 stands for Acquisition of Commercial Products and Commercial Services. FAR Part 12 covers buying commercial products and commercial services, meaning things that are sold or offered to the general public, like janitorial service, lawn care, or standard parts. The idea is to buy the way businesses do, with fewer government-unique rules.

Part 12 buys use a short standard set of clauses, most notably 52.212-4 (contract terms) and 52.212-5 (required laws and orders). Agencies often post a 'combined synopsis and solicitation' that is the notice and the bid request in one document.

Why it matters to a small contractor

Most trade and supply work you see on SAM.gov is bought as commercial under Part 12. Learn the 52.212-4 clause once and you will understand the basic terms of a large share of federal contracts, including inspection, payment, termination, and warranty.

Example

A pest control company reads a combined synopsis and solicitation for quarterly treatments. It cites FAR 52.212-4 and 52.212-5, so they know which standard terms apply and focus their effort on the pricing sheet and past performance.

FAR Part 12: common questions

What is a commercial service in government contracting?

It is a service of a type offered and sold competitively in substantial quantities in the commercial marketplace, at catalog or market prices. Lawn care and janitorial work are typical examples.

Do commercial contracts still require wage rules?

Yes. The Service Contract Act, Davis-Bacon, and other labor laws can still apply through clause 52.212-5. Check the boxes marked in that clause.
