E-Verify (E-Verify (federal contractor rule))

E-Verify stands for E-Verify (federal contractor rule). E-Verify is an online system run by DHS and the Social Security Administration that confirms whether employees are authorized to work in the United States. Under FAR 52.222-54, many federal contracts require contractors to enroll in E-Verify and use it.

Covered contractors generally must enroll within 30 days of contract award and verify new hires and existing employees assigned to the contract within set time frames. The clause generally applies to contracts above the simplified acquisition threshold with a performance period of 120 days or more, with exceptions such as COTS items, and it flows down to certain subcontracts.

Why it matters to a small contractor

If your contract or subcontract includes the E-Verify clause, you need to enroll and use it for the right employees on time. Enrolling is free. Do it as soon as you win, since missing the window is an easy compliance mistake to avoid.

Example

A small janitorial company wins its first federal subcontract that includes FAR 52.222-54. The owner enrolls in E-Verify that week as a federal contractor and verifies the crew assigned to the building.

E-Verify: common questions

Is E-Verify required for all federal contractors?

No. It is required when the contract includes FAR 52.222-54. Check your contract or subcontract clauses.

How long do I have to enroll in E-Verify after award?

Generally 30 calendar days after award if you are not already enrolled. The clause gives the specific deadlines for verifying employees.
